Halle Berry’s alleged stalker is to stand trial.
Los Angeles Superior Court Judge Melissa Widdifield ruled during a hearing on Monday that Richard A. Franco was fit to stand trial and face burglary and trespassing charges against him.

Franco was arrested outside Berry’s home in July after he was seen on the property three times in as many days.

Los Angeles police Detective John Gregozek testified that when Franco was caught, he was carrying a key to Berry’s guesthouse, which he reportedly obtained by breaking into the house.

Berry, who was not present at the hearing, called police after spotting Franco outside her kitchen door.

Franco will remain in jail until he returns to court for arraignment at the end of the month.
