Los Angeles authorities have been granted permission to proceed with prosecuting Hayden Panettiere’s boyfriend for a felony domestic violence charge relating to an alleged altercation earlier this year (19).
Brian Hickerson was arrested by police on 2 May after an argument with the former Nashville star at her home reportedly turned physical.
Officers were called to the property to investigate the domestic disturbance, and took Hickerson into custody after reportedly noticing redness and marks on the actress’ body.
His lawyers tried to fight the count in court on Wednesday (10Jul19), arguing Panettiere was also to blame for the fall-out, but the judge ruled prosecutors had enough evidence to move forward with the case, and denied the defendant’s motion for dismissal, reports Us Weekly.
Hickerson, a realtor and aspiring actor, previously pleaded not guilty to the charge, while he was also slapped with a restraining order, demanding he stay at least 100 yards (91.44 meters) away from Panettiere.
If convicted of the felony, he faces up to four years in prison.
The 29-year-old star was first linked to Hickerson last August (18), shortly after her split from her fiance, former boxing champ Wladimir Klitschko, the father of her four-year-old daughter Kaya.
